Definition

The writer share is the half of a composition's performance royalties that belongs to the songwriters. ASCAP, BMI, SESAC and GMR pay it directly to the writer, and in the United States it cannot be assigned away to a publisher in the normal course of a deal.

The writer share is the songwriter's protected half. When a performing rights organization pays a performance royalty, it splits the money into a writer share and a publisher share and pays them to different account types. The writer share goes to the human being credited as a writer of the composition, in whatever proportions the writers registered.

The reason this half matters is durability. Even when a songwriter signs a full publishing deal and assigns the copyright, US PRO practice is that the writer share continues to be paid directly by ASCAP, BMI, SESAC or GMR to the writer, not routed through the publisher's account first. It is the one piece of publishing income that does not pass through somebody else's hands on the way to yours.

Within the writer half, the split among co-writers is whatever the writers agree. Two co-writers at 50/50 each hold 50% of the writer share; expressed the way registrations usually work, each is a 50% writer on the composition. A split sheet signed in the room is what makes those percentages a fact rather than a memory.

The misunderstanding to avoid: seeing a statement that shows "50%" and concluding you have been shortchanged. If you are registered only as a writer and not as a publisher, receiving the writer share alone is the system working exactly as designed. The missing half is not stolen; it is unclaimed, and claiming it means registering a publisher entity with the same PRO.
